Final Order Entered: 1. The findings contained in the Commission Staff’s Report are adopted as modified by this Order and incorporated by reference into this Order as if fully set out in this Order. 2. The general service rates proposed by Caldwell District are denied. 3. The rates set forth in Appendix B to this Order are approved for services rendered by Caldwell District on and after the date of this Order. 4. Within 20 days of the date of service of this Order, Caldwell District shall file with this Commission, using the Commission’s electronic Tariff Filing System, new tariff sheets setting forth the rates and charges approved herein and their effective date, and stating that the rates and charges were authorized by this Order. 5. Caldwell District shall use the midpoint of the depreciable lives of the National Association of Regulatory Utility Commissioners ranges, as proposed in the application and agreed upon by Commission Staff, to depreciate water plant assets for accounting purposes in all future reporting periods. No adjustment to accumulated depreciation or retained earnings should be made to account for this change in the accounting estimate. 6. This case is closed and removed from the Commission’s docket. |

Order Entered: 1. Caldwell District’s amended application is accepted as filed as of March 22, 2022. 2. Caldwell District shall not place the proposed rates into effect until the Commission issues an Order approving the rates or six months from the date the application was amended, whichever comes first. 3. Within 14 days of the date of this Order, Caldwell District shall notify its customers of the implementation of the rates calculated in the Commission Staff Report by publishing notice of the increase in a newspaper of general circulation in its territory or placing an insert in bills rendered to its customers. The customer notice shall contain the information set forth in the Appendix to this Order. 4. Caldwell District shall provide proof of publication of the notice to the Commission no later than 30 days from the date of this Order. 5. If the Commission does not receive any written requests for intervention or a hearing in this matter within 30 days of publication of new rates, this case shall stand submitted to the Commission for decision based upon the existing record. |

Order Entered: 1. The procedural deadlines established in the November 30, 2021 procedural schedule, with the exception of the deadline for requests to intervene, should be stricken and replaced with the procedural schedule attached to this Order as Appendix A. 2. Caldwell District should file on or before the date set forth in the amended procedural schedule its responses to the Commission Staff’s First Request for Information, attached to this Order as Appendix B. 3. All other provisions of the November 30, 2021 Order not in conflict with this Order shall remain in full force and effect. |

Order Entered: 1. The procedural schedule set forth in the Appendix to this Order, which is attached hereto and incorporated herein, shall be followed. 2. In addition to the procedural schedule set forth in the Appendix, no later than March 14, 2022, Commission Staff shall file with the Commission and serve upon all parties of record a written report (Staff Report) containing its findings and recommendations regarding Caldwell District’s requested rate adjustment. 3. No later than 14 days after the date of the filing of the Commission Staff Report, each party of record shall file with the Commission: a. Its written comments on and any objections to the findings contained in the Commission Staff Report; and b. Any additional evidence for the Commission to consider. 4. If Commission Staff finds that Caldwell District’s financial condition supports a higher rate than Caldwell District proposes or the assessment of an additional rate or charge not proposed in Caldwell District’s application, Caldwell District in its response to the Commission Staff Report shall also state its position in writing on whether the Commission should authorize the assessment of the higher rate or the additional rate or charge. |
