This Motion is a request to deviate or suspend the sewer division rate increases set to go into effect on January 1, 2023.

Order Entered nunc pro tunc, that: 1. The language in Appendix A “2-Inch Meter, First 10,000 Gallons; All Over 10,000 Gallons” is stricken and is replaced with the following language: 2-Inch Meter First 50,000 Gallons $328.31 Minimum Bill All Over 50,000 Gallons 0.00600 Per Gallon 2. All other provisions of the Commission’s November 24, 2021 Order that are not in conflict with the terms of this Order shall remain in effect.

Final Order Entered: 1. The adjustments and recommendations contained in this Order are adopted. 2. The water and sewer rates proposed by Garrison District are denied. 3. The water rates set forth in Appendix A to this Order are approved for services rendered by Garrison District on and after the date of this Order. 4. The Phase 1 sewer rates set forth in Appendix B to this Order are approved for services rendered by Garrison District on and after the date of this Order. 5. The Phase 2 sewer rates set forth in Appendix B to this Order are approved for services rendered by Garrison District on and after one year of the date of this Order. 6. The Phase 3 sewer rates set forth in Appendix B to this Order are approved for services rendered by Garrison District on and after two years of the date of this Order.

Order Entered: 1. Within 14 days from the date of this Order, Garrison District shall publish a one-time notice following the requirements of 807 KAR 5:076, Section 5, of the sewer rates, water rates, and water loss surcharge as reflected in Garrison District’s July 26, 2021 comments to the Staff Report. The customer notice shall be formatted as set forth in the Appendix to this Order. 2. Garrison District shall provide proof of publication of the notice to the Commission no later than 20 days from the date of this Order. The Commission directs Garrison District to the Commission’s July 22, 2021 Order in Case No. 2020-00085 regarding filings with the Commission. 3. If the Commission does not receive any written requests for intervention or a hearing in this matter within 30 days of publication of new rates, this case shall stand submitted to the Commission for decision based upon the existing record.

No later than July 13, 2021, Commission Staff shall file with the Commission and serve upon all parties of record a written report containing its findings regarding Garrison District’s requested rate adjustment. 2. All provisions of the Commission’s Order of March 11, 2021, in conflict with the provisions of this Order are vacated. All other provisions of the Order of March 11, 2021, shall remain in effect.
