Final Order Entered: 1. The findings contained in the Staff Report are adopted and incorporated by reference into this Order as if fully set out herein. 2. The general service rates proposed by Nixutil Association are denied. 3. The rates set forth in the Appendix to this Order are approved for services rendered by Nixutil Association on and after the date of this Order. 4. Within 20 days of the date of this Order, Nixutil Association shall file with this Commission, using the Commission's electronic Tariff Filing System, new tariff sheets setting forth the rates and charges approved herein and their effective date, and stating that the rates and charges were authorized by this Order. 5. Nixutil shall include in the new tariff sheets language reflecting how the approved late fee will be applied. 6. The revenues collected pursuant to the interim rate established by the April 1, 2019 Order in this matter are no longer subject to refund. 7. No refund of the interim rate is due because the rates approved in this order are higher than the interim rates. 8. Nixutil is relieved of the obligation in the April 1, 2019 Order that it maintains records of the interim rates to determine the amounts to be refunded and to whom any refund of the interim rate is due. 9. This case is closed and removed from the Commission's docket.

Order Entered: 1. No later than July 29, 2019, Commission Staff shall file with the Commission and serve upon all parties of record a written report containing its findings and recommendations regarding Nixutil's requested rate adjustment. 2. All other provisions of the Commission's April 1, 2019 Order not in conflict with this Order shall remain in full force and effect.

Commission Staff's Initial Request for Information to Nixutil Sanitation Association, Inc.

Order Entered: 1. The rates proposed by Nixutil in its application are suspended until August 3, 2019, or until further order by the Commission. 2. Nixutil is authorized to place into effect the interim base rates, subject to refund, set forth in Appendix A to this Order for service rendered on and after April 1, 2019. 3. Nixutil shall maintain its records in such a manner as will enable it, or the Commission, to determine the amounts to be refunded and to whom any refund is due in the event that a refund of any portion of the interim base rate increase is ordered by the Commission. 4. Within 20 days of the date of this Order, Nixutil shall file with the Commission, using the Commission's electronic Tariff Filling System, Nixutil's revised tariff with its interim rates as set forth in this Order, subject to refund, reflecting that it was approved pursuant to this Order. 5. No later than May 13, 2019, Commission Staff shall file with the Commission and serve upon all parties of record a written report containing its findings regarding Nixutil's requested rate adjustment (Commission Staff Report). 6. No later than 14 days after the date of the filing of the Commission Staff Report, each party of record shall file with the Commission: a. Its written comments on, and any objections to, the findings and recommendations contained in the Commission Staff Report; and b. Any additional evidence for the Commission to consider.

Order Entered: 1. Nixutil's request for deviations from the filing requirements in 807 KAR 5:076, Section 4(1 )(d), and 807 KAR 5:076, Section 4(1 )(f), is hereby granted. 2. Nixutil's application shall be deemed fi led on February 4, 2019.
